The arbitration agreement, sometimes dubbed the "champagne clause" for its last-minute inclusion in contracts, often lacks the attention it truly deserves. A poorly drafted arbitration clause can severely undermine your ability to enforce contractual rights. Without a clear and effective dispute resolution mechanism, the contract risks being rendered ineffective, no matter its terms on paper.
